Terms and Conditions
By registering to become a member of LocalFlowerShop.com you agree to the following Terms and Conditions. You understand that violating any of the following terms may result in the immediate cancellation of your membership and removal of your directory listing. You understand that in such case, the remainder of your membership is forfeited and non-refundable. You also agree that LocalFlowerShop.com may, at it's sole discretion, remove a member for any reason, or for no reason at all. If such removal is not due to a violation of the Terms and Conditions, LocalFlowerShop.com will refund the unused portion of the membership dues.
As the mission of LocalFlowerShop.com is to foster positive change within the floral industry by connecting the consumer directly to a LOCAL florist, we consider the integrity of our listings to be of the utmost priority. This means that all members must ONLY choose to be listed in cities to which they physically deliver daily with company owned vehicles and their own employees. No exceptions to this rule will be tolerated. Violations of this rule include, but are not limited to: accepting an order and wiring it to another florist, use of "delivery pools", use of third party delivery services or shipping flowers via overnight services. Any florist found in violation of this rule will be immediately removed. LocalFlowerShop.com periodically sends "test orders" to ensure that "order gathering" is not taking place within the directory.
All members are required to have a physical, retail location and to be a legitimately licensed business in their community.
Listing descriptions and photographs:
All text and photographs in listings must not contain false, libelous, profane, racist or otherwise offensive language or materials. Members are advised to keep all shop information current and accurate at all times. False claims of awards, accreditations, hours of operations, location, etc are unacceptable. Any derogatory reference to a competitor is also a violation of these terms of service.
Please check your listing for accuracy. If you find an error in your listing, please contact us immediately. LocalFlowerShop.com is not responsible for errors or omissions unless we have been notified in writing, either via mail or email by the member.
All members are expected to conduct business in a professional, customer focused manner. LocalFlowerShop.com expects all members to stand behind their products and services and to make every reasonable effort to resolve customer complaints. If LocalFlowerShop.com receives an unusually high number of verifiable complaints against a member, the listing may be subject to deletion without refund.
By joining LocalFlowerShop.com you agree to receive promotional materials via email and/or postal mail. Your information will be used only by LocalFlowerShop.com. We will not share or sell your email address or any other information.
Credit/Debit Card Authorization:
By submitting your credit/debit card ("Bank Card") data to LocalFlowerShop.com, you authorize LocalFlowerShop.com in its complete discretion to submit a financial transaction(s) to your issuing bank for settlement. You agree that once LocalFlowerShop.com has approved or declined your transaction, LocalFlowerShop.com has fully performed under the terms of this Agreement. All memberships are recurring and do not expire. By providing us with your account information, you agree that your account will be automatically debited either on a monthly or annual basis, depending on the term you select. Your account will be debited each month or year without prior notification. This will continue until you notify us that you wish to cancel.
In the event that you desire to cancel any recurring charge you must do so using our online cancellation form prior to the next billing cycle. Should you fail to properly cancel online, you agree to indemnify and hold LocalFlowerShop.com harmless from any losses or damages that you suffer as a result of a recurring charge. No cancellation is considered final unless you receive an email confirming cancellation. If you do not receive a confirmation email by the next business day, your cancellation request was not received and you must re-submit. Cancellation can ONLY be completed online, using the cancellation form. If you think that there is an error on your account, including an incorrect amount or unauthorized transaction, you agree to contact LocalFlowerShop.com within 60 days. Upon proper notification, LocalFlowerShop.com, in its sole discretion may issue a credit to your Bank Card.
Any check dishonored for insufficient funds, closed account, or any other reason will result in the following fees in accordance with the laws of the State of Florida: Amount of check $50.00 or less - Fee = $25.00 per check. Amount of check $50.01 - $300.00 - Fee = $30.00 per check. Amount of check $300.01 or more - Fee = $40.00 per check or an amount equal to 5% on the face value of the check, whichever is greater.
Any refunds due to early membership termination, change in billing plans, or any other reason may, at the sole discretion of LocalFlowerShop.com will be subject to a 15% service fee.
You agree that LocalFlowerShop.com, it's parent company and affiliates are not liable for and will be held harmless for any communications, transactions, or actions of any members, consumers or vendors.
These Terms and conditions are subject to change without notice. It is the responsibility of the member to review this document periodically for changes or additions.
